1. Service provider and contact
Planistage provides live-performance software for Windows and Android together with optional account, online saving and synchronization services. Service-provider and billing details are displayed during checkout and on the applicable invoice. Questions about these terms may be sent to info@planistage.com.
2. Acceptance of the terms
By downloading or using Planistage, creating an account or purchasing a paid plan, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the service. You must have the legal capacity required to enter into this agreement.
3. Software download and local use
The Planistage installer and Android APK may be downloaded without registration. Subject to these terms, Planistage grants you a limited, non-exclusive, non-transferable and revocable licence to install and use the software for your own lawful personal or professional live-performance activities.
You may not resell, sublicense, distribute modified copies, bypass technical protections, use the service unlawfully or attempt to interfere with its infrastructure. Rights granted by mandatory law, including permitted interoperability or security research, are not restricted.
4. Accounts and the free trial
An account is required only for features such as online saving, synchronization and the reserved area. Registration requires accurate information and a valid email address. You are responsible for protecting your password and for activity performed through your account.
The 30-day trial starts when you confirm your email. No credit card is required. The trial does not automatically convert into a paid plan and no amount is charged when it expires. If you do not activate a paid plan, online account features may be suspended, while any local-use capabilities available in the installed software remain subject to the software version and technical limitations.
5. Annual paid plan
After the trial, you may choose to activate the annual plan for the price shown on the website and at checkout, currently EUR 29 for twelve months. Payment is initiated only when you expressly select the checkout action.
The checkout page will state whether the selected plan is a one-year purchase or a recurring annual subscription. If recurring billing is offered and selected, it will renew according to the terms shown at checkout until cancelled. You may manage or request cancellation by contacting Planistage. Cancelling stops future renewals and does not normally shorten a period already paid for, subject to mandatory consumer rights.
6. Consumer withdrawal and refunds
If you are an EU or EEA consumer, you may have a statutory right to withdraw from a distance service contract within 14 days. Exceptions can apply to digital content or services supplied immediately after your express request and acknowledgement. Any mandatory withdrawal, conformity, refund or remedy rights under applicable consumer law remain unaffected.
Outside mandatory rights, refund requests are assessed based on the circumstances, service use and any terms presented at checkout. Contact info@planistage.com with the account email and payment details.
7. Your content and backups
You retain ownership of setlists, notes, project data and other content you create or upload. You grant Planistage only the rights reasonably necessary to store, process, transmit and synchronize that content to provide the service.
You are responsible for having the rights to use backing tracks, scores, PDFs and other material added to Planistage. The service is not a substitute for your own backup. Keep copies of material that is important to your performances.
8. Availability, updates and compatibility
Planistage aims to provide a reliable service, but uninterrupted or error-free operation is not guaranteed. Maintenance, connectivity, third-party services, device settings or events outside reasonable control may affect availability.
System requirements and compatibility may change as Windows, Android and connected devices evolve. Updates may add, alter or remove features where reasonably necessary for security, compatibility or improvement, while respecting applicable rights for digital services.
9. Live-performance responsibility
Live performance involves equipment, venue, connectivity and timing conditions outside Planistage's control. Test your project, audio routing, MIDI devices, power supply and backup plan before a show. You remain responsible for deciding whether the software and your configuration are suitable for a specific performance.
10. Suspension and termination
You may stop using Planistage at any time. Planistage may suspend or terminate an account for material breach, misuse, security risk, non-payment or unlawful activity, normally after reasonable notice where appropriate. On termination, access to online features may end. Requests concerning account data may be made under the Privacy Policy and applicable data-protection law.
11. Liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer protections. To the extent permitted by law, Planistage is not liable for indirect or consequential losses, loss of opportunity, or losses caused by user equipment, third-party services, unlawful content or failure to prepare reasonable performance backups.
12. Privacy and personal data
Personal data is processed as described in the Privacy Policy and applicable data-protection law. Registration information should be limited to what is necessary for account, support and service operation. Optional notes should not contain sensitive or unnecessary personal information.
13. Changes to the service or terms
Planistage may update these terms to reflect legal, security, technical or service changes. Material changes affecting an active paid service will be communicated with reasonable notice where required. The effective date above identifies the current version.
14. Governing law and disputes
These terms are governed by Italian law, without depriving consumers of mandatory protections available in their country of residence. Courts and dispute-resolution rights provided by mandatory consumer law remain available. Before starting formal proceedings, please contact info@planistage.com so the issue can be reviewed.
15. Severability and entire agreement
If any clause is found invalid or unenforceable, the remaining clauses continue to apply. These terms, the Privacy Policy and the information shown at checkout form the agreement concerning the relevant Planistage service.
